In this case, the defendant knew that he was illegally dealing in refined oil, but still carried out covert sales and mobile sales of oil tankers in order to obtain profits, and his behavior had disrupted the order of the refined oil market and infringed the legitimate rights and interests of consumers, and should be subject to criminal punishment
according to law.
This is the first case in Wenshan Prefecture to be sentenced to prison for illegal operation of refined oil, and it is also the first refined oil case in Yunnan Province after the abolition of the "Measures for the Administration of Refined Oil Products" for illegal operation, which further promotes the legal order of the province's refined oil market, effectively deters lawbreakers, and protects the legitimate rights and interests
of consumers.

It is understood that the Ministry of Commerce has never issued a refined oil retail license qualification to "mobile fuel trucks", and although the "Measures for the Administration of Refined Oil Products" were abolished in 2020, the Administrative Licensing Law of the People's Republic of China still includes the qualification approval setting for refined oil wholesale, warehousing and retail operation into the administrative license catalog, and "mobile fuel trucks" are clearly illegal operations
