On October 8, 2021, the United States Trade Representative (USTR) issued an announcement in the Federal Register ("FR"), regarding the 549 Chinese products that have been approved for exclusion and extended the validity period of the exclusion under the 301 tariff list of the United States.
Comments are sought on the extension of the statute of limitations for further renewal of product exclusion taxation
.
This batch of tariff exclusion list mainly includes anti-epidemic materials, mechanical equipment, mechanical and electrical products and furniture
.
For the specific list of 549 existing products excluded from the extension, please refer to Annex 1 (click "read the original text" below to view)

Zhejiang enterprises are invited to actively submit comments and continue to strive for the opportunity to extend the exclusion of US 301 taxed products
.
How to submit comments on the extension of the validity period of the tariff exclusion list

(2) Time for submitting comments
The online platform channel has been opened on October 12, 2021, and the comment period is 50 days until December 1, 2021

(3) Key points for submitting information
For the 549 products that have been previously excluded and have been extended for exclusion, USTR plans to re-evaluate each case based on the following criteria to determine whether to restore the exclusion period:
whether certain products or comparable products can be supplied by U.
S.
domestic industry or a third country;
Whether the global supply chain for certain products or related industry developments has changed since September 2018;
Efforts by U.
S.
importers or downstream users to seek alternative sources of products from within the U.
S.
or a third country since September 2018;
U.
S.
domestic production capacity for this product
.
In addition, USTR will consider whether reinstating a product exclusion would cause impact or serious economic harm to commentators or other U.
S.
stakeholders, including to U.
S.
small businesses, U.
S.
domestic employment, U.
S.
manufacturing output and related Supply chain impacts and impact on achieving the goal of eliminating Chinese behaviors, policies and practices covered in Section 301 investigations

(4) Exclusion period
Once a product exclusion validity period is reinstated, its exclusion validity period will be retroactive to October 12, 2021
.
Imported goods from China that have been declared at customs but have not been cleared after this period will no longer be subject to corresponding 301 tariffs
