drugs and psychotropic substances and drug-making articles, the office of the National Drug Control Commission issued the circular on prevention of illegal crimes in non-medical narcotic drugs and psychotropic substances and drug-making articles (hereinafter referred to as the circular) to the whole society on August 1 In recent years, under the influence of the international drug tide and the stimulation of windfall profits, some companies and personnel in China have been attacked and dealt with by the domestic law enforcement departments or charged by the foreign law enforcement departments due to their insufficient understanding of the relevant laws and regulations of the drug-making articles and non-medical narcotic drugs and psychotropic substances, and they have taken the risk to illegally process, sell and smuggle the drug-making articles, non-medical narcotic drugs or psychotropic substances Sanction The circular issued by the national drug control office has 10 articles in total, summarizing the control of non-medical narcotic drugs, psychotropic substances and drug-making articles by the criminal law of the people's Republic of China, drug law of the people's Republic of China, regulations on the administration of precursor chemicals, measures for the control of non-medical narcotic drugs and psychotropic substances, provisions on the administration of the import and export of precursor chemicals and other laws and regulations Control regulations, as well as relevant regulations for postal, logistics, express delivery enterprises and other units and individuals on the prevention of non pharmaceutical narcotic drugs, psychotropic drugs and drug-making articles The Circular aims to remind relevant enterprises and the masses to abide by relevant laws and regulations when engaging in business activities, so as to effectively curb such illegal and criminal activities In order to effectively strengthen the control of non pharmaceutical narcotic drugs, psychotropic drugs and drug products and effectively curb such illegal and criminal activities, the circular on prevention of non pharmaceutical narcotic drugs, psychotropic drugs and drug products is hereby promulgated as follows in accordance with the relevant laws and regulations of the state: 1、 According to the provisions of article 350 of the criminal law of the people's Republic of China, it is strictly prohibited for any organization or individual to illegally produce, trade in, transport acetic anhydride, ether, chloroform or other raw materials and preparations used in the manufacture of drugs, or to bring the above-mentioned articles into or out of the country It is strictly prohibited for any organization or individual to produce, trade or transport the articles as prescribed in the preceding paragraph for others knowing that they are manufacturing drugs 2、 According to the relevant provisions of the criminal law of the people's Republic of China, whoever knowingly produces, sells, transports or imports or exports a certain non listed substance for the purpose of illegally manufacturing non pharmaceutical narcotic drugs or psychotropic substances shall be punished as an accomplice in the crime of manufacturing drugs 3、 According to the provisions of articles 21 and 22 of the drug control law of the people's Republic of China, it is strictly prohibited for any organization or individual to illegally produce, trade, transport, store, provide, hold and use narcotic drugs, psychotropic drugs and precursor chemicals Smuggling of narcotic drugs, psychotropic drugs and precursor chemicals by any organization or individual is strictly prohibited 4、 According to the provisions of the measures for the control of non pharmaceutical narcotic drugs and psychotropic substances, in addition to the varieties listed in the supplementary catalogue of non pharmaceutical narcotic drugs and psychotropic substances, non pharmaceutical narcotic drugs and psychotropic substances also include the possible salts, optical isomers and their salts 5、 According to Article 5 of the regulations on the administration of precursor chemicals, it is strictly prohibited for any organization or individual to smuggle or illegally produce, operate, purchase, transfer or transport precursor chemicals Trading of precursor chemicals in cash or in kind is strictly prohibited It is strictly prohibited for individuals to carry precursor chemicals into or out of the country, except for pharmaceutical compound preparations and potassium permanganate for their own use 6、 According to Article 47 of the provisions on the administration of the import and export of precursor chemicals, it is strictly prohibited for any organization or individual to import or export precursor chemicals without permission or beyond the scope of permission, and it is strictly prohibited for an individual to bring precursor chemicals into or out of the country, except for the pharmaceutical compound preparations and potassium permanganate reasonably used by an individual 7、 If any postal, logistics or express delivery enterprise finds any illegal mailing, transportation or entrainment of raw materials or preparations for making narcotic drugs or psychotropic drugs, precursor chemicals, etc., it shall immediately report to the public security organ or the customs, and cooperate with the public security organ or the Customs for investigation Postal, logistics and express enterprises shall truthfully record or keep the above information 8、 If any unit or individual rents or transfers its special equipment such as reaction kettle, centrifuge, hydrogen cylinder, etc., it shall truthfully register the information of the leased or transferred enterprise or individual, and timely report the registration information to the local county (city, district) work safety supervision department and the public security organ 9、 Knowing that a certain kind of non-medical narcotic drugs and psychotropic substances or drug-making articles have been listed as drugs or precursor chemicals for control abroad and still producing, selling and smuggling them to the country, they may face criminal charges or sanctions from the law enforcement department of the country 10、 Encourage the masses to report to the public security and other relevant administrative departments the illegal and criminal acts of new psychoactive substances and other drugs or drug products If the report is true, a cash reward will be given in accordance
