After investigation, the parties started to do foreign wine business at the end of 2020, and the main customer group is KTV in Shipu area

The relevant person in charge of the Xiangshan County Market Supervision Bureau stated that the self-made foreign wine involved in the above case was a commodity that infringed the exclusive right to use a registered trademark, and the parties violated the "Trademark Law of the People's Republic of China"

According to Paragraph 2 of Article 69 of the Provisions of the Ministry of Public Security of the Supreme People's Procuratorate on the Standards for Filing and Prosecution of Criminal Cases Under the Jurisdiction of Public Security Organs (2), the use of its registered trademark on the same commodity without the permission of the owner of the registered trademark If the same trademark is counterfeited with two or more registered trademarks, and the illegal business volume is more than 30,000 yuan or the illegal income is more than 20,000 yuan, a case shall be filed for prosecution
