According to the Ministry of Commerce, after repeated revisions and improvements, the "Anti-Monopoly Law of the People's Republic of China" (draft for review) has been formed.
The draft for review includes the main contents of the anti-monopoly laws of various countries, such as prohibition of monopoly agreements, prohibition of abuse of dominant market positions, control of concentration of operators, anti-monopoly authorities, legal responsibilities, etc.
, while combining Chinese characteristics and actual needs, Corresponding provisions have also been made for the prohibition of administrative monopoly.
The Ministry of Commerce recently established an anti-monopoly investigation office in charge of anti-monopoly legislation and related work, with Shang Ming, director of the Department of Treaty and Law of the Ministry of Commerce, concurrently serving as the director of the office.
Shang Ming believes that the current monopoly phenomenon in China's economic life is prominent in two aspects: one is market monopoly in the economic sense, such as entering into agreements to fix prices, restricting output, dividing the market, and abusing market dominance.
