Global Coatings Network News: Recently, the Department of Industry and Information Technology of Jiangxi Province issued the "Implementation Rules for the Construction Standards and Identification Management of Chemical Industry Park in Jiangxi Province (Trial)", which will be implemented
from December 22, 2022.
The implementation rules stipulate that chemical parks that have not passed the certification shall not build, renovate or expand chemical projects (except for safety, environmental protection, energy conservation and intelligent transformation projects).
The people's governments of districted cities and counties (cities and districts) shall, in accordance with laws and regulations, properly do a good job in rectifying or closing chemical parks that have not passed the designation, as well as the supervision and disposal of enterprises in the
parks.
Organize and carry out self-assessment and review
of certified chemical parks every 5 years.
If it is determined that the chemical park fails the review and the occurrence of major or above production safety accidents or environmental emergencies, it shall be rectified within a time limit in accordance with laws and regulations, and the relevant procedures for new construction, reconstruction and expansion of chemical projects (except for safety, environmental protection, energy conservation and intelligent transformation projects) shall be stopped during the rectification period.
Implementation Rules for the Construction Standards and Identification Management of Chemical Parks in Jiangxi Province (Trial)
Chapter I General Provisions
Article 1 In order to standardize the construction and identification management of chemical parks and improve the level of safe development and green development of chemical parks, these implementation rules are formulated in accordance with the national Administrative Measures for the Construction Standards and Identification of Chemical Parks (Trial) (Lianyuan [2021] No.
220 of the Ministry of Industry and Information Technology), the Implementation Opinions of the General Office of the Jiangxi Provincial Party Committee of the Communist Party of China and the General Office of the People's Government of Jiangxi Province on Comprehensively Strengthening the Safe Production of Hazardous Chemicals (Ganban Fa [2020] No.
32) and the relevant work requirements of the provincial people's government, combined with the actual conditions of our province
。
Article 2 The provincial people's government shall bear overall responsibility
for the construction and identification management of chemical parks in the province.
The Provincial Department of Industry and Information Technology, the Provincial Development and Reform Commission, the Provincial Department of Natural Resources, the Provincial Department of Ecology and Environment, the Provincial Department of Housing and Urban-Rural Development, the Provincial Department of Transportation, the Provincial Emergency Department, the Provincial Water Conservancy Department, and the Provincial Fire and Rescue Corps organize all parts of the province to carry out the identification and management of chemical parks according to their responsibilities, and guide the construction of chemical parks in all localities
.
Article 3 Chemical parks shall be administered territorially, and the people's governments of each districted city and county (city or district) shall bear overall responsibility
for the construction and management of chemical parks in their respective regions.
Article 4 The term "chemical park" as used in these implementation rules refers to an industrial zone
approved and established by the people's government, guided by the development of the chemical industry, with clear geographical boundaries and management subjects, and complete infrastructure and management system.
The chemical parks that have passed the certification as used in these implementation rules (hereinafter referred to as the designated chemical parks) refer to chemical parks that have been jointly reviewed by the Provincial Department of Industry and Information Technology, the Provincial Development and Reform Commission, the Provincial Department of Natural Resources, the Provincial Department of Ecology and Environment, the Provincial Department of Housing and Urban-Rural Development, the Provincial Department of Transportation, the Provincial Emergency Department, the Provincial Water Conservancy Department and the Provincial Fire and Rescue Corps, and have been examined and approved by the Provincial People's Government and meet the requirements of these Implementation Rules
.
Chapter II: Construction Standards
Article 5 The establishment of chemical parks shall be complete in formalities, carry out planning environmental impact assessment and overall safety risk assessment in accordance with law, and pass the review
of relevant departments.
Article 6 Chemical parks shall have clear management institutions, have effective management capabilities in production safety, environmental protection, emergency rescue, etc.
, and be equipped with personnel
to meet the safety management and environmental protection needs of chemical parks.
Article 7 The site selection and layout of chemical parks shall comply with relevant laws, regulations, policies and relevant plans
。 It is strictly forbidden to select sites
in earthquake faults, geological disaster-prone areas, ecological protection red lines, permanent basic farmland, nature reserves, drinking water source protection areas, and other environmentally sensitive areas.
The external safety protection distance between the chemical park and the urban built-up area, densely populated area, important facilities and other protection targets should meet the requirements of relevant standards, and the surrounding planning safety control line
should be set up.
Article 8 The management agency of the chemical park shall draw up the overall plan and industrial plan
。 The overall plan shall include chapters on production safety, emergency rescue, ecological environmental protection, conservation and intensive land use, and comprehensive disaster prevention and mitigation, or independently prepare relevant special plans
.
The industrial plan should be prepared in combination with the basic conditions of local land resources, industrial foundation, water resources, environmental capacity, urban construction, logistics and transportation, etc.
, in line with the national chemical industry policy and the requirements of regional ecological environment zoning control and chemical industry development planning
.
Article 9 Chemical parks shall have a reasonable layout and functional zoning, and the places where administrative offices, life services and other personnel are concentrated in the park are separated from the production and storage areas of hazardous chemicals, and the safety distance shall meet the requirements
of relevant standards.
Article 10 The management body of the chemical park shall formulate a catalogue
of "prohibitions, restrictions and control" of hazardous chemicals adapted to regional characteristics and local realities.
Establish an evaluation system for projects entering the park, and the projects entering the park shall meet the relevant requirements
of the national chemical industry policy and planning.
Article 11 Chemical parks shall, in accordance with the requirements of "categorical control, hierarchical management, and step-by-step implementation", combine the actual conditions of the industrial structure, industrial chain characteristics, and safety risk types, implement closed management in the zone, establish an access control system and a video surveillance system, and supervise
the whole process of the entry and exit of materials, personnel and vehicles such as flammable, explosive, toxic and harmful chemicals.
Chemical parks should strictly control transportation safety risks, implement special roads, special lanes, and time-limited speed driving, and build special parking lots for hazardous chemical vehicles as needed to prevent the accumulation of
safety risks.
Article 12 Chemical parks shall have the capacity to collect all the hazardous wastes they generate, and make overall plans to build hazardous waste utilization and disposal capacity according to the hazardous waste generation of the park and the hazardous waste utilization and disposal capacity
of the area.
Key sites or key facilities and equipment involving toxic and harmful substances in chemical parks (especially underground storage tanks, pipe networks, etc.
) should be designed and constructed to prevent leakage and eliminate hidden dangers
of soil and groundwater pollution.
Chemical parks should establish a sound control and control system
for volatile organic compounds.
Article 13 The chemical park shall, in accordance with the requirements of classified collection and quality treatment, be equipped with professional centralized chemical production wastewater treatment facilities (independently built or relying on backbone enterprises) and supporting pipe networks with special management or open pipe transportation, and the wastewater in the park shall be fully covered, centrally treated and discharged up to standard; Where there are wharves, facilities for the reception, transshipment and disposal of water pollutants from ships shall be equipped in accordance with relevant regulations; Where a sewage outlet is set up into the river, the setting of the sewage outlet shall comply with relevant regulations
.
Article 14 Chemical parks shall, in accordance with the overall planning, functional zoning and main product characteristics, establish systems, plans, platforms and full-time emergency rescue teams that meet the emergency handling needs of sudden production safety accidents and environmental emergencies, and be equipped with personnel and equipment
that meet the requirements of relevant national and industry standards.
Chemical parks should adopt the methods of self-construction, joint construction and entrusted services, and support the construction of chemical safety skills training bases
.
Chemical parks shall build a waste water prevention and control system for accidents in the park in accordance with relevant regulations, and do a good job in the collection, temporary storage and treatment
of accident wastewater.
Article 15 Chemical parks shall, according to the needs of their own scale and industrial structure, establish a sound monitoring and monitoring system for safe production and ecological environment and risk early warning, and relevant monitoring and monitoring data shall be connected to local monitoring and early warning systems
.
Article 16 The management body of the chemical park shall, in accordance with relevant provisions, carry out work such as risk demonstration of the external dangerous goods transportation of the park
.
Chapter III: Identification of Parks
Article 17 The Provincial Department of Industry and Information Technology, together with the Provincial Development and Reform Commission, the Provincial Department of Natural Resources, the Provincial Department of Ecology and Environment, the Provincial Department of Housing and Urban-Rural Development, the Provincial Department of Transportation, the Provincial Emergency Department, the Provincial Water Conservancy Department and the Provincial Fire and Rescue Corps, shall be responsible for the identification of chemical parks, and each department shall jointly promote relevant work
according to their duties.
Article 18 The management body of the chemical park shall submit application and recognition materials
to the local people's government in accordance with its affiliation.
The people's government where the chemical park is located shall organize a preliminary review of the application materials, and issue an audit opinion, and will meet the requirements of Grade C (general safety risk) and above stipulated in the "Guidelines for Safety Risk Investigation and Governance of Chemical Parks (Trial)" (Emergency [2019] No.
78) of the Ministry of Emergency Management and the requirements of the construction standards of chemical parks in these implementation rules, and submit them to the Provincial Department of
Industry and Information Technology for gradual-by-level review.
Article 19 After receiving the relevant materials, the Provincial Department of Industry and Information Technology shall distribute them to the Provincial Development and Reform Commission, the Provincial Department of Natural Resources, the Provincial Department of Ecology and Environment, the Provincial Department of Housing and Urban-Rural Development, the Provincial Department of Transportation, the Provincial Emergency Department, the Provincial Water Conservancy Department and the Provincial Fire and Rescue Corps
.
Each department conducts departmental audits (including data audits or on-site audits) in accordance with their responsibilities, and issues departmental audit opinions
.
On-site audits can be carried out
by each department by organizing expert reviews or entrusting professional third-party institutions to conduct comprehensive assessments.
Article 20 The Provincial Department of Industry and Information Technology, together with the Provincial Development and Reform Commission, the Provincial Department of Natural Resources, the Provincial Department of Ecology and Environment, the Provincial Department of Housing and Urban-Rural Development, the Provincial Department of Transportation, the Provincial Emergency Department, the Provincial Water Conservancy Department and the Provincial Fire and Rescue Corps, shall study and determine the list of chemical parks to be designated based on the review opinions of various departments, and announce
it to the public.
If there is no objection after the expiration of the publicity period, it shall be reported to the provincial government for examination and approval, and it will be announced
as a designated chemical park.
Chapter IV Park Management
Article 21 The relevant departments of local people's governments at all levels shall be responsible for the relevant management of chemical parks on the basis of
their duties。 The development and reform, industry and information technology departments are responsible for the industrial planning of chemical parks, the approval or filing of projects entering the park, the industrial transformation and upgrading of chemical parks and high-quality development according to their responsibilities; The ecological environment department is responsible for environmental protection supervision and guidance of environmental emergency management in chemical parks; The transportation department is responsible for guiding the risk demonstration of the external dangerous goods transportation of chemical parks; The emergency management department is responsible for the safety production supervision and safety emergency management of relevant enterprises in the chemical park; The natural resources department is responsible for the land use and planning guarantee of the park, and the review of the compliance of land and spatial planning; The housing and urban-rural development department is responsible for the supervision and management of municipal public infrastructure construction activities in the park; The water conservancy department is responsible for providing the boundary of the river and lake management scope involved in the chemical park and the supervision of water and soil conservation in the chemical park; The fire rescue department is responsible for the work related to fire rescue in the chemical park

The management agency of the chemical park is responsible for the overall management of the work of the chemical park
.
Article 22 Chemical parks that have not passed the certification shall not build, renovate or expand chemical projects (except for safety, environmental protection, energy conservation and intelligent transformation projects).
The people's governments of districted cities and counties (cities and districts) shall, in accordance with laws and regulations, properly do a good job in rectifying or closing chemical parks that have not passed the designation, as well as the supervision and disposal of enterprises in the
parks.
Article 23 The establishment of new chemical parks shall be approved by the people's governments at or above the provincial level, and the acceptance of chemical projects included in relevant national or local plans shall be subject to the consent of the people's governments at the provincial level, and the chemical parks shall pass the certification before the
projects are put into operation.
Article 24 The Provincial Department of Industry and Information Technology, in conjunction with the Provincial Development and Reform Commission, the Provincial Department of Natural Resources, the Provincial Department of Ecology and Environment, the Provincial Department of Housing and Urban-Rural Development, the Provincial Department of Transportation, the Provincial Emergency Department, the Provincial Water Conservancy Department, the Provincial Fire Rescue Corps and other departments, shall organize and carry out a self-assessment and review of the designated chemical park every five years
.
Article 25 Where it is determined that the chemical park fails the review and the occurrence of major or above production safety accidents or environmental emergencies, it shall be rectified within a time limit in accordance with laws and regulations, and the relevant procedures for new construction, reconstruction and expansion of chemical projects (except for safety, environmental protection, energy conservation and intelligent transformation projects) shall be stopped during the rectification period.
In the event of a major or above production safety accident, the emergency management department shall supervise and inspect the implementation of prevention and rectification measures in the occurrence of the accident; Where major or above environmental emergencies occur, the ecological and environmental departments are to put forward corrective measures and handling opinions
in accordance with relevant provisions.
Article 26 The Provincial Department of Industry and Information Technology, in conjunction with the Provincial Development and Reform Commission, the Provincial Department of Natural Resources, the Provincial Department of Ecology and Environment, the Provincial Department of Housing and Urban-Rural Development, the Provincial Department of Transportation, the Provincial Emergency Department, the Provincial Water Conservancy Department and the Provincial Fire and Rescue Corps, shall periodically publish the list of designated chemical parks, the number of chemical enterprises in the designated chemical parks, production safety, environmental protection
, etc.
Chapter V Supplementary Provisions
Article 27 "Approved by the people's government" as used in Article 4 of these Implementation Rules refers to the national Administrative Measures for the Construction Standards and Identification of Chemical Parks (Trial) (Lianyuan [2021] No.
220) approved by the people's government at the county level or above before the promulgation, and approved by the people's government at the provincial level or above after the promulgation
.
Article 28 These implementation rules shall be interpreted by the Provincial Department of Industry and Information Technology, the Provincial Development and Reform Commission, the Provincial Department of Natural Resources, the Provincial Department of Ecology and Environment, the Provincial Department of Housing and Urban-Rural Development, the Provincial Department of Transportation, the Provincial Emergency Department, the Provincial Water Conservancy Department, and the Provincial Fire Rescue Corps together with relevant departments
.
Article 29 The division of labor for the identification of chemical parks in Jiangxi Province shall be formulated
separately.
Article 30 These implementation rules shall come into force on December 22, 2022, and the Administrative Measures for the Identification of Chemical Parks in Jiangxi Province (Trial) (Gangong Xin Guizi [2021] No.
2) issued on February 8, 2021 shall be abolished
at the same time.
