Regulations on the Safety Management of Hazardous Chemicals

Article 37 Enterprises dealing in hazardous chemicals shall not purchase hazardous chemicals from enterprises engaged in the production and business activities of hazardous chemicals without permission, and shall not deal in hazardous chemicals without chemical safety technical specifications or chemical safety labels

Article 78 In any of the following circumstances, the production safety supervision and management department shall order corrections and may impose a fine of not more than 50,000 yuan; Those who refuse to make corrections shall be fined between 50,000 and 100,000 yuan; If the circumstances are serious, order the suspension of production and business for rectification:

(1) The unit producing or storing hazardous chemicals has not set up obvious signs for the hazardous chemical pipelines it has laid, or has not regularly inspected or tested the hazardous chemical pipelines;

(2) Carrying out construction operations that may endanger the safety of pipelines of hazardous chemicals, and the construction unit fails to notify the unit to which the pipeline belongs in writing in accordance with regulations, or fails to jointly formulate an emergency plan and take corresponding safety protection measures with the unit to which the pipeline belongs, or the unit to which the pipeline belongs does not assign special personnel to the scene to carry out pipeline safety protection guidance;

(3) The hazardous chemical production enterprise fails to provide a chemical safety technical specification, or fails to paste or hang the chemical safety label on the packaging (including the outer packaging);

(4) The chemical safety technical specification provided by the hazardous chemical production enterprise is inconsistent with the hazardous chemicals produced by it, or the chemical safety labels affixed or hung on the packaging (including the outer packaging) are inconsistent with the hazardous chemicals in the packaging, or the content contained in the chemical safety technical specifications and chemical safety labels does not meet the requirements of national standards;

(5) Hazardous chemical production enterprises discover that the hazardous chemicals they produce have new hazardous characteristics and do not immediately announce them, or do not promptly revise their chemical safety technical specifications and chemical safety labels;

(6) Hazardous chemicals trading enterprises dealing in hazardous chemicals without chemical safety technical specifications and chemical safety labels;

(7) The materials of the packaging and containers of hazardous chemicals, as well as the type, specifications, methods and quality (weight) of individual pieces of packaging are incompatible with the nature and use of the hazardous chemicals packaged;

(8) Units producing or storing hazardous chemicals do not set up obvious safety warning signs in the workplace and safety facilities and equipment, or fail to set up communication or alarm devices in the workplace;

(9) There is no special person in the special warehouse for hazardous chemicals to be responsible for management, or there is no system of double receipt, dispatch, and double custody of stored highly toxic chemicals and other hazardous chemicals whose stored quantities constitute a major source of danger;

(10) The unit storing hazardous chemicals has not established a verification and registration system for the entry and exit of hazardous chemicals;
