On October 31, 2016, DSM Desotech, Elgin, Illinois and their Dutch company (collectively, DSM) filed a lawsuit asking the U.S. International Trade Commission (ITC) to investigate under Section 337 of the Customs Act.lawsuit alleges that Meitu UV Coatings (Shanghai) Co., Ltd., OSS Volkswagen Telecom Co., Norcross Co., Ltd., Georgia (collectively, "Object of Investigation") illegally imported and sold UV-cured fiber coatings, coated fiber optics, and similar products in the U.S., infringing several U.S. patent numbers, including 696 1508 (Patent No. 508), 7171103 (Patent No. 103), 7067564 (Patent No. 564), 7706659 (Patent No. 659) (collectively, "Protected Patent").protected patents relate to optical fiber coating products. Where "508" and "103" relate to fiber optic coatings, such as first- and second-stage coatings used to protect optical fibers. "564" and "659" involve optical fiber coatings that improve performance to compensate for defects, and some defects in the fiber itself can lead to loss of signals during transmission.lawsuit, DSM noted that the import and sale of products by the subjects of the investigation violated patent rights and specifically named Kearshield single-mode and multimode fiber coatings, AllWave fiber and EZ-Bend single-mode fiber as infringing products.DSM claims to have filed a lawsuit in the U.S. District Court for the Southern District of Ohio against Meitu UV Coatings (Shanghai) Co., Ltd. and Mitut Chemicals Inc. Reference was also made to proceedings against Corning in the District Courts, and patents 508 and 103 had earlier been subject to multiple reviews by the United States Patent and Trademark Office, which were still ongoing., out of respect for the outcome of the processing, DSM requested the Commission to issue permanent exclusion and permanent stay orders against the subjects of the investigation.
