Decision on Amending the "Provisions on the Management of Pesticides in the Hainan Special Economic Zone"

The twenty-third meeting of the Standing Committee of the Fifth People’s Congress of Hainan Province decided to make the following amendments to the "Provisions on Pesticide Management in Hainan Special Economic Zone": The administrative department and the food and drug supervision and administration department shall supervise and manage the pesticides and agricultural products sold on the market in accordance with their respective responsibilities

” The fourth paragraph is amended to read: “The quality and technical supervision of the people’s government at or above the county level, health, environmental protection, forestry, fishery, etc.
Administrative departments such as transportation and post shall be responsible for the supervision and management of pesticides in accordance with their respective responsibilities
.

A paragraph is added to Article 5 as the third paragraph: "The production of fake pesticides and low-quality pesticides is prohibited
.
" The first paragraph of Article 8 is amended as: “Pesticide wholesale and retail prices are subject to government-guided prices, which shall be formulated by the provincial people’s government price department in conjunction with the agricultural administrative department and relevant departments and announced to the public
.
” Add two paragraphs as the third.
Paragraph 4: "The competent price department of the provincial people's government and the people's government of cities, counties and autonomous counties shall assess the wholesale and retail prices of pesticides in a timely manner
.
"The competent price departments of the people's governments at or above the county level shall strengthen supervision and inspection of the wholesale and retail prices of pesticides.
Investigate and deal with price violations in accordance with the law

"One paragraph is added as the third paragraph: "Pesticide wholesale enterprises shall not allow other units or individuals to use their pesticide wholesale business licenses in any form to engage in pesticide business activities in their name

No unit or individual may borrow, fraudulently use or embezzle the name of a pesticide wholesale enterprise to engage in pesticide business activities
.
"Change the third paragraph to the fourth paragraph and amend it to read: "Pesticide wholesalers who purchase pesticides shall ask for proof of purchase from pesticide manufacturers or suppliers
.
Pesticide wholesalers selling pesticides shall issue purchase certificates to pesticide buyers
.
When purchasing pesticides, pesticide retail operators shall ask for the purchase certificate from the wholesale enterprise
.
A pesticide retail operator who sells pesticides shall issue a purchase certificate to the pesticide purchaser
.
Pesticide buyers who purchase pesticides should ask for proof of purchase
.
The pesticide purchase certificate shall record the name, quantity, purpose of the pesticide and relevant information of the buyer and seller, and shall be kept together with the purchase and sales account for verification
.

Amend Article 14 to read: "Pesticide retail operations shall purchase pesticides from wholesale enterprises in this special economic zone
.
" Except for the pesticides purchased by wholesale pesticide transportation enterprises, and the pesticides approved for scientific research and promotion and demonstration by the agricultural administrative department of the provincial people's government, units and individuals are not allowed to purchase, transport or carry pesticides into this special economic zone without authorization
.
"Pesticides should be purchased at pesticide shops that have obtained business licenses
.
"It is forbidden to purchase pesticides from outside the special economic zone through online trading platforms
.

Amend the third paragraph of Article 15 to read: "The administrative departments of agriculture, industry and commerce, and transportation of the people’s government at or above the county level shall set up pesticide checkpoints at ports, railway stations, long-distance bus stations, airports, etc.
The postal, civil aviation, railway and other departments shall cooperate with the inspection of pesticides in the special economic zones
.

Amend the first paragraph of Article 16 to read: "Pesticide operators shall establish a pesticide purchase and sales account to record the production unit, purchase channel, product name, sales situation and other information of the pesticide sold
.
The pesticide purchase certificate and the purchase and sales account shall be kept for three years
.

Amend the first paragraph of Article 17 to read: "Pesticide distributors shall receive training and possess professional knowledge of pesticide use and safety protection
.
10.
Amend Article 18 to: "It is forbidden to sell fake pesticides and low-quality pesticides
.
"It is forbidden to sell food, agricultural products, daily sundries and other commodities closely related to the lives of the people in pesticide business sites
.

The first paragraph of Article 23 is amended to read: "Pesticide users shall comply with the state and this special economic zone.
Regulations on the use of pesticides
.
The following actions are prohibited: (1) Use pesticides not in accordance with the scope of use, methods, technical requirements, and precautions indicated on the label; (2) Use pesticides not in compliance with the safety interval or withdrawal period indicated on the pesticide label; (3) Use pesticides in drinking water Use of pesticides in violation of relevant regulations in the water source protection zone; (4) Other violations of relevant regulations on the use of pesticides

At the end of the second paragraph of Article 23, add: “Encourage other producers of agricultural products to establish production records of agricultural products

Amend Article 29 to read: “The agricultural administrative department of the people’s government at or above the county level shall strengthen the Supervision and random inspection of the production, purchase, and sales of agricultural products in administrative regions; the food and drug supervision and administration department of the people's government at or above the county level shall, in accordance with their duties, conduct supervision and random inspections on the agricultural products sold in the administrative region
.
