On September 17th, the Official Website of the National Development and Reform Commission (NDRC) announced that, in accordance with the Interim Measures for the Administration of Tariff Quotas for Agricultural Imports (Ministry of Commerce, National Development and Reform Commission Order No. 4 of 2003), the National Development and Reform Commission (NDRC) has formulated the rules for the application and distribution of tariff quotas for food imports in 2021.
, the total amount and type of grain import tariff quota for 2021 is: wheat (including its powder, grain, hereinafter referred to as wheat) 9.636 million tons, of which 90% is the state trade quota; 7.2 million tons, 60 per cent of which are state-owned trade quotas, and 5.32 million tons of rice (including its powder, grain, hereinafter referred to as rice), of which 2.66 million tons of long grain rice, 2.66 million tons of short- and medium-sized grain rice, 50 percent is state-owned trade quota.
enterprises may apply for their own options: (1) State-owned trade quotas;
Among them, the quota of state-owned trade allocated to enterprises shall be imported through the agent of the state-owned trading enterprise, and if no import contract is signed before August 15 of that year, the enterprise may entrust any enterprise with the right to trade to import, and the enterprise with the right to trade may import it on its own.
. Enterprises that are eligible for the 2021 wheat, corn and rice import tariff quotas must first meet the following conditions: registration with the market supervision and administration department before October 1, 2020;
Enterprises that are eligible for the 2021 wheat, corn and rice import tariff quota must also meet one of the following conditions for the corresponding varieties: (1) wheat 1, obtain the 2020 wheat import tariff quota and have import performance (the import of agents entrusted by the import tariff quota enterprises shall not be included in the import performance of the entrusted enterprises, the same below);

, the overall objective of the principle of distribution is to make full use of State trade quotas and non-State trade quotas in accordance with market conditions.
(1) If the total amount of import tariff quota published in these Rules can meet the total amount of applications of eligible enterprises, the amount of applications shall be distributed according to the number of applications made by enterprises.
(2) If the total amount of import tariff quota published in these Rules does not meet the total amount of applications of eligible enterprises, the amount of quotas to be divided between enterprises with import performance shall not be less than the amount of imports within the quota of the previous year.
, if there is a residual quota, it is allocated to enterprises that had no import performance in the previous year, taking into account production and processing capacity.
(3) If an enterprise that obtains an import tariff quota fails to complete all the imports within the quota, it shall be dealt with in accordance with the relevant penalties of the Interim Measures for the Administration of Import Tariff Quotas for Agricultural Products.

(ii) The entrusting agency shall, by November 15, 2020, deliver all application forms completed in accordance with the requirements to the National Development and Reform Commission (NSF) and copy them to the Ministry of Commerce, and upload the information contained in the application form to the quota management system for import tariffs on important agricultural products.
