According to the "Implementation Opinions", Shandong Province will implement strict prevention at the source, strict management of the process, and severe penalties for the "two highs" projects, and promote the coordinated control of pollution and carbon reduction.

In order to implement the "Guiding Opinions of the Ministry of Ecology and Environment on Strengthening the Prevention and Control of the Source of the Ecological Environment of High Energy Consumption and High Emission Construction Projects" (Environmental Assessment [2021] No.
45) and the "General Office of the People's Government of Shandong Province on Strengthening the "Two Highs" Project Management Notice (Luzheng Banzi [2021] No.
57) requires the implementation of the following implementation opinions on strengthening the prevention and control of the ecological environment of the province's high energy-consuming and high-emission (hereinafter referred to as "two highs") construction projects
.
1.
Implement the "three lines and one order" and strengthen planning and environmental impact assessment constraints
(1) Strictly implement the requirements of ecological environment zoning management and control
.
All cities should give full play to the fundamental role of the "three lines and one single" (red line for ecological protection, bottom line for environmental quality, online resource utilization, and ecological environment access list) in optimizing the pattern of regional development and protection and improving the level of refined management of ecological and environmental protection.
(2) Efforts to improve the effectiveness of planning environmental impact assessment constraints
.
The municipal ecological environment bureaus shall guide and urge relevant comprehensive plans and special plans for industry and energy related to the "two highs" industries to carry out planning environmental assessment work in accordance with the law, and strictly plan environmental assessment reviews in terms of implementation timing, industrial structure, planning layout, and development scale.

Strictly evaluate and approve the environment, and control the environmental access of the "two highs" projects

(8) Promote the inclusion of the environmental impact assessment of carbon emissions into the EIA system

In accordance with the unified deployment of the Ministry of Ecology and Environment, pilot projects of carbon emission environmental impact assessment of the “two highs” projects in the chemical, steel and other industries are carried out, and cities are encouraged to expand the scope of pilot industries in accordance with local conditions, and to implement relevant regional and industry carbon peak action plans and clean Policy requirements such as energy substitution, clean transportation, total coal consumption control, etc.

4.
Strictly permit pollution discharge and strengthen the supervision and law enforcement of "two highs" projects
(9) Strictly issue and manage pollutant discharge permits
.
In the process of reviewing the issuance of pollution permits for "two highs" enterprises, the municipal pollutant emission permit issuing departments shall comprehensively verify the implementation of various ecological environmental protection measures and regional reduction measures in the environmental assessment and approval documents, and cancel or change the emission reduction transfer unit in accordance with the law.

The “two highs” enterprises that implement key management of pollutant discharge permits must strengthen on-site inspections, and will not issue approvals for those that do not meet the requirements in accordance with the law

It is necessary to strengthen the inspection of the quality of the pollution discharge permits of the "two highs" enterprises and the submission of the implementation reports, and urge the enterprises to do a good job in accounting records, implementation reports, self-monitoring, and disclosure of environmental information

It is necessary to urge the "two high" enterprises that have been rectified within the time limit for the discharge permit to speed up the completion of the rectification task, and if they find that the rectification has not been completed on time or that there is an unlicensed discharge, they shall be investigated and punished strictly in accordance with the law

(10) Strengthen law enforcement and supervision based on pollutant discharge permits

The municipal ecological and environmental bureaus shall include the "two highs" enterprises in the daily law enforcement supervision of "double random, one open", increase inspections of the "two highs" enterprises' pollution discharge and environmental information disclosure in accordance with the law, and supervise the implementation of the certificate holders.

Severely crack down on all kinds of illegal activities such as unlicensed and non-licensed pollutant discharge by "two high" enterprises, and timely expose typical cases of violations of the pollutant discharge permit system

Consolidate work responsibilities and ensure that the policy takes effect

Municipal Eco-Environmental Bureaus shall organize a dragnet investigation of the environmental assessment documents accepted and approved since the "13th Five-Year Plan" and the "two highs" projects included in the plan by relevant departments, and establish an ecological environment management account for the "two highs" projects (see Attachment), submitted to the Provincial Department of Ecology and Environment before August 20, 2021, and updated at the end of each quarter

(12) Strengthen supervision and inspection

The municipal ecological and environmental bureaus shall establish a working mechanism for the supervision and inspection of the environmental impact assessment and pollutant discharge permits for the “two highs” projects, increase the technical review of the environmental assessment documents of the “two highs” projects that have been approved, and the provincial level will review the newly approved “two highs” since 2021.
Projects are reviewed one by one, and any fraudulent behaviors such as plagiarism of environmental impact assessment documents, omissions of key contents, and errors in data conclusions are found, they shall be dealt with strictly in accordance with laws and regulations

For those already under construction, the focus will be on whether the ecological and environmental protection measures are implemented at the same time and whether there are major changes

For those that have been put into production or use, it is also necessary to focus on the implementation of the environmental impact assessment documents and the approved ecological environmental protection measures and the reduction and substitution of key pollutant areas, as well as the application and implementation of pollution permits
.
Problems found in the daily supervision and inspection of the "two highs" enterprises should be recorded in the "two highs" project ecological environment management account in time
.
(13) Strengthen accountability
.
Municipal Eco-Environmental Bureaus shall strictly investigate violations of laws and regulations such as “two highs” projects, “building before approval”, failure to implement environmental impact assessment and “three simultaneous” requirements, and severely deal with those verified to be true in accordance with laws and regulations
.
Strengthen the accountability of examination and approval and supervisory personnel for failing to perform their duties according to law, and for lax inspections
.
If the local government's ineffective implementation of the ecological environment prevention and control measures of the "two highs" project is prominent, the regional approval limit shall be implemented in accordance with the law, and it shall be included in the key content of the provincial ecological environmental protection inspection
.
All municipal ecological environment bureaus and relevant municipal administrative examination and approval service bureaus shall implement the implementation of these implementation opinions and submit them to the Provincial Department of Ecological Environment in writing before August 20, 2021
.
If there are no clear provisions in this implementation opinion, the relevant requirements of the Ministry of Ecology and Environment, the Provincial Party Committee and the Provincial Government shall be strictly implemented
