    Administrative Measures for the Construction Standards and Identification of Chemical Parks in Henan Province (Trial)
     
    Chapter I General Provisions
     
    Article 1 In order to standardize the construction and identification management of chemical parks in our province, improve the level of safe development and green development of chemical parks, and promote the high-quality development of the chemical industry, these Measures are formulated in accordance with the Notice of the Ministry of Industry and Information Technology and other six ministries and commissions on Printing and Distributing the Administrative Measures
    for the Construction and Identification of < Chemical Parks (Trial>) (Ministry of Industry and Information Technology Lianyuan [2021] No.
    220), with reference to the Guidelines for the Investigation and Governance of Chemical Parks (Trial) and other documents, combined with the actual conditions of our province.

     
    Article 2 The term "chemical park" as used in these Measures refers to an industrial zone
    approved and established by the people's government, guided by the development of the chemical industry, with clear geographical boundaries and management subjects, and complete infrastructure and management system.
    "Certified chemical parks" as used in these Measures (hereinafter referred to as "certified chemical parks") refers to chemical parks
    that meet the requirements of these Measures with the approval of the provincial government.
    The newly established chemical park refers to the chemical park
    approved after the implementation of these Measures.

     
    Chapter II: Construction Standards
     
    The third park layout
    .
    The site selection and layout of chemical parks should comply with relevant laws and regulations, policy provisions, relevant planning and industry management or technical specifications, meet the relevant requirements of land and spatial planning and ecological environmental protection, safe production, emergency rescue, resource utilization, comprehensive disaster prevention and mitigation, transportation, etc.
    , and have a clear scope and coordinates
    .
    In principle, the planned contiguous area of the chemical park is 3 square kilometers or more, and the construction mode of "one district and multiple parks" can be adopted
    .

     
    The chemical park shall not be in the direction of the dominant wind and upwind in the main urban area, and the external safety protection distance between it and the protection targets such as urban built-up areas, densely populated areas, and important facilities shall meet the requirements of relevant standards, and the surrounding land planning safety control line
    shall be set up.
    Chemical parks shall have a reasonable layout and functional zoning, and the places where administrative offices, life services and other personnel are concentrated in the park are separated from the production and storage areas of hazardous chemicals, and the safety distance shall meet the requirements
    of relevant standards.

     
    It is strictly forbidden to select sites
    in earthquake faults, geological disaster-prone areas, ecological protection red lines, permanent basic farmland, nature reserves, drinking water source protection areas, and other environmentally sensitive areas.
    It is forbidden to build or expand new chemical parks
    within the control area of the shoreline of the main tributaries of the Yellow River.

     
    Article 4 Park planning
    .
    The management agency of the chemical park shall prepare the overall plan and industrial plan, carry out water resources demonstration in accordance with the law, and pass the review
    of relevant departments.
    The overall plan shall include chapters on production safety, emergency rescue, ecological environmental protection, conservation and intensive land use, and comprehensive disaster prevention and mitigation, or independently prepare relevant special plans
    .
    The industrial plan should be prepared in combination with the basic conditions of local land and mineral resources, industrial foundation, water resources, environmental capacity, urban construction, logistics and transportation, etc.
    , in line with the national chemical industry policy and the requirements of regional ecological environment zoning control and control and the development plan
    of the chemical industry.
    Clarify the industrial positioning of the park, the leading industrial chain of key development, and the infrastructure and public service platforms
    for key construction.
    There shall be no labor-intensive non-chemical enterprises
    in the chemical park.

     
    Article 5 Park facilities
    .
    Chemical parks shall uniformly plan, construct and manage public works such as water supply, power supply and heat supply that meet the needs of industrial development and related facilities
    that meet the requirements of safe production and environmental protection.
    Build public pipe corridors for transporting chemicals, steam and sewage across enterprises as needed, and build facilities such as lighting, anti-collision, and fire emergency response
    .
    Chemical parks should strictly control transportation safety risks, realize special roads, special lanes, and time-limited speed driving, and build special parking lots for hazardous chemical vehicles as needed to prevent the accumulation of
    safety risks.

     
    Article 6 Park management
    .
    Chemical parks should clarify the management structure, set up departments for safe production, ecological environment, emergency rescue and other departments with clear responsibilities and appropriate rights and responsibilities as needed, and be equipped with responsible persons with professional background in chemical industry and personnel to meet the needs of safety management and environmental protection, and have effective management capabilities in production safety, environmental protection, emergency rescue, etc.
    ; Where the park has multiple districts, there shall be a unified operation and management organization
    .
    The management agency of the chemical park shall formulate a catalogue of "prohibition, restriction and control" of hazardous chemicals that is suitable for regional characteristics and local realities, carry out risk demonstration of the transportation of dangerous goods outside the park in accordance with relevant regulations, and establish an evaluation system for entry projects that meet the relevant requirements of national chemical industry policies and planning, such as an evaluation system for entry projects, an information disclosure system, a safety production liability insurance mechanism, a liability care system, and an occupational health and safety management mechanism

    Article 7: Park security
    .
    Chemical parks shall carry out overall safety risk assessment in accordance with the law and pass expert review
    .
    In accordance with the requirements of "classified control, hierarchical management, step-by-step implementation", combined with the actual situation of industrial structure, industrial chain characteristics, safety risk types and other actual conditions, the district implements closed management, establishes access control systems and video surveillance systems, and implements whole-process supervision
    of the entry and exit of materials, personnel and vehicles such as flammable, explosive, toxic and harmful chemicals.

     
    Chemical parks should establish a sound safety production monitoring and monitoring and risk early warning system according to their own scale and industrial structure needs, including but not limited to high-altitude observation video surveillance, key roads and intersection video surveillance, enterprise hazardous place video surveillance, major hazard source monitoring and monitoring, toxic and harmful gases and combustible gas monitoring and monitoring, etc.
    , real-time monitoring of all key areas involving "two key points and one major", and relevant monitoring and monitoring data should be connected to the local monitoring and early warning system

    The chemical park shall, according to the overall planning, functional zoning and main product characteristics, establish an emergency rescue system, plan, platform and full-time emergency rescue team that meets the emergency handling needs in the case of sudden production safety accidents, and be equipped with personnel, equipment and emergency materials
    that meet the requirements of relevant national standards and industry standards.
    Chemical parks should adopt the methods of self-construction, joint construction and entrusted services, and support the construction of chemical safety skills training bases
    .
    The construction rate of hazardous chemical industry safety production standardization enterprises in the chemical park meets the relevant requirements
    .

     
    Article 8 Environmental protection
    of the park.
    Chemical parks shall carry out planning environmental impact assessments in accordance with the law and pass the review
    of the ecological environment department.
    It has the ability to collect all the hazardous wastes generated, and coordinate the construction of hazardous waste utilization and disposal capacity according to the hazardous waste generation in the park and the hazardous waste utilization and disposal capacity
    of the region.
    Air, soil and groundwater monitoring shall be carried out in accordance with relevant regulations, and key sites or key facilities and equipment involving toxic and harmful substances in chemical parks (especially underground storage tanks, pipe networks, etc.
    ) shall be designed and constructed to prevent leakage to eliminate hidden dangers
    of soil and groundwater pollution.
    Chemical parks should establish a sound control and control system
    for volatile organic compounds.

     
    The chemical park shall, in accordance with the requirements of classified collection and quality treatment, be equipped with professional centralized chemical production wastewater treatment facilities (independently built or relying on backbone enterprises) and supporting pipe networks for special or open pipe transportation, and the wastewater in the park should be fully absorbed, centrally treated and discharged
    up to standard.
    Where a sewage outlet is set up into a river, the setting of the sewage outlet shall comply with relevant regulations

    Chemical parks should establish a sound ecological environment monitoring and risk early warning system according to their own scale and industrial structure needs, and relevant monitoring and monitoring data should be connected to the local monitoring and early warning system
    .
    The environmental quality of air, water and soil meets the relevant standards
    .
    The chemical park shall, in accordance with the overall planning, functional zoning and main product characteristics, establish an emergency rescue system, plan, platform and full-time emergency rescue team that meet the emergency handling needs in the case of environmental emergencies, and be equipped with personnel and equipment
    that meet the requirements of relevant national standards and industry standards.
    In accordance with relevant regulations, build a prevention and control system for accident wastewater in the park, and do a good job in the collection, temporary storage and treatment
    of accident wastewater.
    Chemical parks shall establish a list of characteristic pollutants, and carry out cleaner production audits
    of key enterprises in accordance with law.

     
    Article 9 Development
    of the park.
    Chemical parks should strictly implement the relevant requirements of the state (province) on strict energy efficiency constraints to promote energy conservation and carbon reduction, use high-efficiency and energy-saving clean production processes in accordance with the requirements of reduction, reuse and recycling, promote process innovation and technological upgrading, promote the comprehensive utilization of by-product resources, do a good job in energy conservation and carbon reduction technology transformation in energy-consuming industries, and effectively curb the blind development of
    the "two highs" projects.

     
    Encourage the park and enterprises in the park to adopt a new generation of information technology (such as 5G communication technology, artificial intelligence technology, etc.

    informatization, digitalization and intelligence.
    Build intelligent workshops and smart factories, strengthen the construction of information management platforms, fully integrate the information resources of the park, use a variety of means to build smart chemical parks, improve perception, monitoring, early warning, disposal and evaluation capabilities, and improve the comprehensive management and control level of
    the park.

     
    Chapter III: Identification of Parks
     
    Article 10 The identification of chemical parks shall be led by the Provincial Department of Industry and Information Technology, with the participation of the Provincial Development and Reform Commission, the Department of Natural Resources, the Department of Ecology and Environment, the Department of Housing and Urban-Rural Development, the Department of Transportation, the Emergency Department and other departments, and each department shall jointly promote relevant work
    according to its duties.

     
    Article 11: Chemical park certification materials
    .

     
    (1) Application documents

    .
    Approval documents of governments at the county level and above on the establishment of parks, overall planning and approval documents of parks, industrial planning and expert argumentation opinions, overall safety risk assessment reports and expert review opinions, planning environmental impact assessment reports and review opinions, water resources demonstration reports and review opinions, overall land space planning of the city, county or township where the park is located, planned construction land area, built-up area area, four-to-four boundary and coordinate vector data and land use documents, safety control line delineation and related coordinate data, The internal layout of the park and the factory floor plan of the equipment and facilities such as major hazards and warehousing (three-dimensional real pictures are provided if possible) and other relevant explanations and supporting materials
    .

     
    (3) Industrial economy
    .
    The average investment intensity of the park in the past three years, the average tax per mu, the proportion and relevance of the built-up area of the chemical industry, the innovation ability and other relevant explanations and supporting materials, including the list of enterprises (including projects under construction) in the park, investment amount, financial statements and land use documents.


     
    (iv) Infrastructure

    The park's public pipeline pipe gallery, central heating, water supply, dual power supply and related facilities that meet the requirements of production safety and environmental protection, and the relevant instructions and supporting materials
    of the special parking lot for hazardous chemical transportation vehicles that meet the requirements of relevant standards and specifications.

     
    (5) Management system

    (6) Safe production
    .
    The park safety emergency management department set up, closed management, safety risk monitoring and monitoring system, emergency command center, fire station, hazardous chemicals industry safety production standardization enterprise construction rate, safety production emergency rescue system, internship training base, emergency plan, professional emergency rescue team, emergency material reserve and other relevant explanations and supporting materials

    (7) Environmental protection
    .
    The ecological and environmental management department of the park is set up, wastewater collection and treatment system, hazardous waste treatment and disposal system, environmental monitoring and monitoring system, air, water and soil environmental quality compliance rate, characteristic pollutant list database construction, key enterprise cleaner production audit, environmental emergency response system and other relevant explanations and supporting materials

    (8) Resource utilization

    (9) Integration

    Park information platform construction, intelligent workshop identification, intelligent factory certification and other relevant explanations and supporting materials

    (10) Other materials

    Article 12: Procedures
    for Designation.
    The park management body applying for recognition is responsible for organizing the application materials, and reviewing and submitting
    them step by step in accordance with the following procedures.

     
    (1) Application for
    designation.
    The county (city, district) government where the park is located shall submit application materials
    for recognition to the provincial and municipal governments.

     
    (2) Preliminary examination
    at the municipal level.
    The provincial and municipal governments (including the administrative committees of the Jiyuan Demonstration Zone and the Airport Area, the same below) shall conduct a preliminary review of the application materials for certification in accordance with the requirements of these Measures, form a preliminary review report, and submit the list and scoring table of parks that meet the requirements of the recognition standards to the Provincial Department of Industry and Information Technology (with relevant materials)
    in official documents.

     
    (3) Provincial-level review
    .
    The Provincial Department of Industry and Information Technology organized the members and experts of the Henan Provincial Chemical Park Identification and Management Joint Conference (hereinafter referred to as the Provincial Joint Conference) or entrusted professional third-party institutions to review and conduct on-site assessment of the parks that meet the requirements of the certification standards, determine the list of parks to be recognized, and publish it on the website of the Provincial Department of Industry and Information Technology
    .

     
    (4) Announcement of the
    designation.
    If there is no objection after the expiration of the publicity period, it shall be reported to the provincial government for examination and approval, and it will be announced
    as a designated chemical park.

     
    Article 13: Identification Standards
    .

     
    (1) Parks with a total score of 70 points or above in the provincial audit shall be recognized as chemical parks
    .

    (2) Parks with a total score of less than 70 points in the provincial audit shall be rectified within a time limit, and the rectification period shall not exceed 1 year in principle, and no new chemical projects (except for safety, environmental protection, energy conservation and intelligent transformation projects)
    shall be built, renovated or expanded during the rectification period.
    After the rectification is completed, it is necessary to reapply for provincial certification
    .

     
    In the following circumstances, the park shall not be approved: the establishment of the park and the overall plan have not been approved in accordance with the provisions (the approval of the overall plan before the implementation of these Measures is regarded as the establishment approval), the environmental impact assessment and water resources demonstration of the park planning have not been reviewed and approved, the industrial planning has not been approved, and the park has been identified as having a higher safety risk level or above
    .

     
    Chapter IV: Establishment of Parks
     
    Article 14 In principle, no new chemical parks will be established, and if it is really necessary to establish new ones, they must be reported to the provincial government for examination and approval after consultation and approval by the provincial joint meeting; The undertaking of chemical projects included in relevant national or provincial plans shall be approved by the provincial joint meeting, and the chemical park shall be recognized
    before the project is put into operation.

     
    Article 15 The location of newly established chemical parks shall comply with the requirements of Article 3 of these Measures, be far away from the main urban area of the city where they are located, meet the requirements of "three lines and one single" ecological environment zoning management and control, and not be located in environmentally sensitive areas; Overall plans and industrial plans shall be prepared, overall safety risk assessments, planning environmental impact assessments and water resources demonstrations shall be carried out in accordance with the law, and shall be reviewed by relevant departments in accordance with regulations
    .
    The planned contiguous area of the newly established chemical park should be more than 3 square kilometers (inclusive), establish a management organization with clear responsibilities and appropriate powers and responsibilities, clarify the safety production and ecological environment management departments, and allocate personnel
    to meet the needs of safety management and environmental protection.

     
    Article 16 Materials for the establishment of
    chemical parks。

    (3) Management bodies
    .
    The establishment of management institutions, including the establishment of safety production and ecological environment management departments, safety management and environmental protection staffing and other relevant explanations and supporting materials

    Article 17 Procedures for establishing applications and
    approvals.

     
    (1) Application for
    establishment.
    The county (city, district) government where the park is located shall submit the application materials for establishment to the
    provincial and municipal governments.

     
    (2) Preliminary examination
    at the municipal level.
    In accordance with the requirements of these Measures, the governments of provinces and municipalities shall organize relevant departments or experts to conduct a preliminary review of the application materials for establishment, form a preliminary examination report, and submit it to the Provincial Department of Industry and Information Technology (with relevant materials)
    in official documents.

     
    (3) Provincial-level review
    .
    The Provincial Department of Industry and Information Technology organized members of the provincial joint conference to review and on-site review the application materials of the park that met the requirements of the establishment standards in the preliminary examination, and formed an audit report and submitted it to the provincial government for
    approval.

     
    (4) Establishment approval
    .
    After examination and approval by the provincial government, a decision
    to approve the establishment is made.

     
    Chapter V: Expansion of the Park
     
    Article 18 Conditions for the expansion of
    chemical parks。 The expansion of chemical parks should meet the following basic conditions: 1.
    The built-up area reaches 70% or more of the total planned area; 2.
    The average investment intensity per mu and the average tax per mu in built-up areas should meet the benchmark value requirements of provincial development zones; 3.
    In principle, the expansion area should be adjacent to or close to the original chemical park, and should have industrial linkage or public engineering coordination conditions; 4.
    The scale of the expansion area is reasonable, the layout is concentrated, and in principle, there are no non-chemical enterprises (except public and supporting engineering enterprises) in the expansion area, and it does not cross the regional scope
    of counties (cities, districts) and development zones.

     
    Article 19 After the expansion of the chemical park, it shall meet the construction standards
    of Chapter II.

     
    Article 20 Procedures for the declaration and identification of
    chemical park expansion。
     
    (1) Declaration and approval
    .
    Where the provisions of these Measures are met, the provincial or municipal government shall submit an application for area expansion to the Provincial Department of Industry and Information Technology and provide corresponding materials, and after the unanimous approval of the members of the provincial joint conference, an audit report shall be formed and submitted to the provincial government for
    approval.
    After examination and approval by the provincial government, an approval
    for the expansion of the park will be issued.

     
    (2) Construction and identification
    .
    Within 2 years of the approval of the expansion of the park, an application for park recognition shall be made to the Provincial Department of Industry and Information Technology, and the specific recognition procedure shall refer to the provisions of
    Article 12 of these Measures.
    During the implementation period of the expansion, new chemical projects can be built within the scope of the expansion, and the chemical park shall pass the certification before the
    project is put into operation.
    If the application for recognition is not applied for within 2 years or the recognition is not approved, the expansion work shall be terminated, and no new chemical projects shall be built, renovated or expanded in the expanded area (except for safety, environmental protection, energy conservation and intelligent transformation projects), and the chemical projects already built during the period shall not be put into operation
    .

     
    Before the implementation of these Measures, if the park expansion plan has been approved by the provincial municipal government, it shall be directly submitted to the Provincial Department of Industry and Information Technology for review and approval
    .

     
    Article 21 The identification of chemical parks for integration shall be approved by the provincial government, and the re-identification shall be carried out after the integration of the parks (refer to Article 20 of this Chapter for specific procedures).


     
    Chapter VI Park Management
     
    Article 22 The governments of all provinces and municipalities shall perform their territorial regulatory responsibilities, do a good job in the supervision of chemical parks in accordance with laws and regulations, properly do a good job in rectifying or closing chemical parks that have not passed the designation, and the supervision and disposal of enterprises in the
    parks.
    The management agency of the chemical park shall bear the main supervision responsibility and be responsible for the overall management of the work of the chemical park
    .

     
    Relevant functional departments are responsible for the relevant management of
    chemical parks according to their duties.
    The competent department of industry and information technology is responsible for the identification and management of chemical parks in the province, and is specifically responsible for the identification, establishment, overall planning approval and industrial planning review, transformation and upgrading and high-quality development of chemical parks; The competent department of development and reform shall be responsible for the approval or filing of chemical park entry projects, energy consumption, coal and electricity and other production factors according to their duties; The competent department of ecology and environment is responsible for environmental assessment, environmental protection supervision, and guiding environmental emergency management of chemical parks; The competent departments of transportation are responsible for guiding the management agencies of chemical parks to carry out risk demonstration of the transportation of dangerous goods to the outside world according to their duties; The emergency department is responsible for the safety demonstration of hazardous chemical construction projects in the chemical park, the safety production supervision of relevant enterprises and the safety emergency management (the relevant duties involving fire protection work are the responsibility of the fire rescue agency); The competent department of natural resources shall be responsible for reviewing whether the chemical park complies with the territorial spatial plan and other related work according to its functions; The competent departments of housing and urban-rural construction shall be responsible for relevant work
    in accordance with their functions.

     
    Article 23 All local people's governments shall strictly implement the National Catalogue for the Guidance of Industrial Restructuring and relevant policy requirements, and shall prohibit the entry into the park of products, technologies, processes and equipment that have been included in the
    catalogue that are eliminated or prohibited, as well as projects that have major safety hazards, do not have safe and environmentally friendly production conditions, and do not conform to local industrial development plans.

     
    Article 24 Chemical parks that have not passed the certification shall not build or renovate or expand chemical projects (except for safety, environmental protection, energy conservation and intelligent transformation projects).

    Encourage chemical parks that have not passed certification and chemical enterprises outside the park to relocate to chemical parks
    that have passed certification.

     
    Article 25 In any of the following circumstances, the government of the province or municipality where the chemical park is designated shall organize a re-assessment of the current conditions of the park, and if the assessment results meet the requirements for recognition stipulated in these Measures, it shall be submitted to the Provincial Department of Industry and Information Technology for review and filing; Where the assessment results do not meet the requirements of these Measures, rectification shall be carried out within a time limit in accordance with laws and regulations, and the relevant procedures for new construction, reconstruction and expansion of chemical projects (except for safety, environmental protection, energy conservation and intelligent transformation projects) shall be stopped during the rectification period, and if they still do not meet the requirements after the expiration date, the qualification
    for recognition of chemical parks shall be revoked.

     
    (1) Major or more production safety accidents or environmental emergencies occur, or three or more major production safety accidents or environmental emergencies occur consecutively within one year;
     
    (2) Major changes in geological conditions, industrial planning, safety protection distance of enterprises in the park, conditions around the park or safety and atmospheric environment protection distance
    .

     
    Article 26 According to relevant regulations on safety and environmental protection, the management agency of the chemical park shall carry out an overall safety risk assessment at least once every 5 years from the date of designation of the chemical park, and carry out a follow-up environmental impact assessment
    for the park plan that has been implemented for more than 5 years.
    For enterprises that do not meet the requirements of safety, environmental protection and energy saving, have serious hidden dangers and are difficult to rectify, they must be eliminated and withdrawn from the park
    in time.

     
    Article 27 Dynamic management of identified parks shall be carried out, a self-assessment shall be carried out once a year, and the Provincial Department of Industry and Information Technology shall organize a review every three years
    .
    If the review is unqualified, it shall be ordered to rectify within a time limit, and the relevant procedures for new construction, reconstruction and expansion of chemical projects (except for safety, environmental protection, energy conservation and intelligent transformation projects) shall be stopped during the rectification period, and if they still do not meet the requirements after the expiration date, the qualification
    of the chemical park shall be canceled.

     
    Chapter VII Supplementary Provisions
