    General Administration of Customs Announcement No. 115 of 2022 (Announcement on Phytosanitary Requirements for the Import of Cambodian Pepper)

    In accordance with the relevant laws and regulations of China and the regulations of the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Forestry and Fisheries of the Kingdom of Cambodia on the phytosanitary requirements of Cambodian pepper exported to China, from now on, Cambodian pepper that meets the following relevant requirements is allowed to be imported:
     
    1.
    Basis for inspection and quarantine
     
    (1) The "Biosecurity Law of the People's Republic of China";
     
    (2) the Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving the Country, and the Regulations for the Implementation of the Law of the People's Republic of China on the Quarantine of Animals and Plants Entering and Leaving the Country;
     
    (3) the Law of the People's Republic of China on Import and Export Commodity Inspection and the Regulations for the Implementation of the Law of the People's Republic of China on Import and Export Commodity Inspection;
     
    (4) Food Safety Law of the People's Republic of China and Regulations for the Implementation of the Food Safety Law of the People's Republic of China;
     
    (5) Measures of the People's Republic of China for the Administration of Import and Export Food Safety;
     
    (6) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture, Forestry and Fisheries of the Kingdom of Cambodia on the Phytosanitary Requirements for the Export of Cambodian Pepper to China
    .
     
    2.
    Names of goods allowed to be imported
     
    Peppercorns, scientific name Piper nigrum, English name Peppercorns, is limited to edible pepper fruits as raw materials, harvested after threshing, soaking, drying and other processes after processing
    .
     
    3.
    Permitted origins
     
    Cambodian pepper producing area
    .
     
    4.
    Approved planting bases and processing and packaging enterprises
     
    The planting bases and processing and packaging enterprises of pepper exported to China (hereinafter referred to as "pepper") must be reviewed and filed by the Ministry of Agriculture, Forestry and Fisheries of the Kingdom of Cambodia (hereinafter referred to as "Cambodia"), and jointly approved and registered
    by the General Administration of Customs of the People's Republic of China (hereinafter referred to as "China") and Cambodia.
    Registration information includes names, addresses and registration numbers to enable accurate traceability of exported goods in the event that they do not comply with the relevant provisions of this Protocol
    .
    Before the export season each year, the Cambodian side shall provide the Chinese side with the registration list, which will be published
    on the official website after examination and approval by the Chinese side.
     
    5.
    List of quarantine pests of concern
     
    1.

    4.

    Beticola
     
    6.
    Pre-export management
     
    (1) Management
    of planting bases.
     
    1.
    All pepper planting bases shall establish and improve the quality management system and traceability management system under the supervision of the Cambodian side, implement good agricultural practice (GAP), maintain planting hygiene conditions, such as no pollution sources affecting pepper production in the surrounding area, timely clean up plant disease residues, etc.
    , and implement integrated pest management (IPM), including pest monitoring and investigation, physical, chemical or biological control, and agricultural operations and other prevention and control measures
    .
     
    2.
    All pepper planting bases shall, under the supervision of the Cambodian side, carry out pest monitoring and comprehensive management
    for quarantine pests of concern to the Chinese side.
    Pest monitoring and control should be carried out
    under the guidance of professional and technical personnel.
    Technical personnel shall receive training
    from the Cambodian side or its authorized institutions.
     
    3.
    The Cambodian side shall keep records of pest monitoring and control during pepper planting, as well as monitoring plans and records of toxic and harmful substances such as pesticide residues and heavy metal pollutants, and provide
    them to the Chinese side upon request.
    Control records should include information
    such as the name of the chemical agent used during the growing season, the active ingredient, the dosage and the time of use.
     
    (2) Management of processing and packaging plants
    .
     
    1.
    The processing, packaging, storage and shipment of pepper shall be carried out
    under the quarantine supervision of the Cambodian side or its authorized officials.
     
    2.
    The pepper packaging plant should be clean and hygienic, the ground should be hardened, and there should be a raw material yard and finished product warehouse
    .
     
    3.
    The functional areas such as storage, processing, packaging, and storage of pepper are relatively independent, reasonably arranged, and isolated from the living area and have an appropriate distance
    .
     
    4.
    During the processing of pepper, it should go through manual picking, screening, cleaning and other processes to ensure that there are no plant residues and soil such as insects, mites, snails, diseased fruits, rotten fruits, grass seeds, stems and leaves
    .
     
    5.
    The registered packaging plant shall establish a traceability system to ensure that the pepper can be traced back to the registered plantation, and record the date of processing and packaging, the name of the source planting base or its registration number, quantity, export date, export quantity, country of entry, means of transport or container number and other information
    .
     
    (3) Packaging requirements
    .
     
    1.
    Packaging materials should be clean and hygienic, unused, and meet China's relevant plant quarantine requirements
    .
    If wood packaging is used, it must meet the requirements
    of the International Standard for Phytosanitary Measures No.
    15 (ISPM15).
     
    2.
    Traceability information such as product name, country, origin, planting base and packaging plant name and its registration number should be marked on each box in Chinese or English
    .
    Each box and pallet must be marked "Exported to the People's Republic of China" or "Exported to the People's Republic of China"
    in Chinese or English.
     
    3.
    The means of transport or container loaded with pepper must be checked for good sanitary conditions
    at the time of shipment.
    The means of transport or container shall be sealed and shall be in good condition upon arrival at the port of entry of China
    .
     
    (4) Inspection and quarantine
    before export.
     
    1.
    Before export, the Cambodian side should sample and inspect
    the packaged pepper according to the proportion of 2%.
    If no phytosanitary problems occur within two years, the sampling ratio is reduced to 1%.

     
    2.
    If quarantine pests, branches and leaves or soil of concern to the Chinese side are found, the entire consignment shall not be exported to China
    .
    The Cambodian side should identify the causes and take corrective measures
    .
    At the same time, record of the seizure will be kept and provided to the Chinese side
    upon request.
     
    (5) Requirements for phytosanitary certificates
    .
     
    If the quarantine is qualified, the Cambodian side shall issue a phytosanitary certificate in accordance with ISPM12, indicating the name or code of the planting base and packaging plant, and fill in the following additional statement: "This consignment complies with the requirements specified in the Protocol of Phytosanitary Requirements for.
    " Export of Peppercorns from Cambodia to China, and is free from quarantine pests of concern to China.
    ” (The shipment meets the plant quarantine requirements of Cambodian pepper exported to China and does not contain quarantine pests
    of concern to the Chinese side.

    Before the launch of the pepper project, the Cambodian side should provide the Chinese side with a sample of the phytosanitary certificate for confirmation and filing
    .
     
    7.
    Entry inspection and quarantine and unqualified treatment
     
    When pepper arrives at China's port of entry, China Customs implements inspection and quarantine in accordance with the following requirements
    .
     
    (1) Verification
    of relevant certificates and markings.
     
    1.
    Verify whether the phytosanitary certificate complies with the provisions
    of Article 6 (5) of these requirements.
     
    2.
    Verify whether the marking on the box complies with the provisions
    of Article 6 (3) of this requirement.
     
    (2) Entry inspection and quarantine
    .
     
    In accordance with relevant laws, administrative regulations, rules and other provisions, imported pepper shall be inspected and quarantined, and those who pass the inspection and quarantine shall be allowed to enter the country
    .
     
    (3) Unqualified handling
    .
     
    1.
    If it is found to come from an unregistered planting base or packaging plant, the batch of pepper is not allowed to enter the country
    .
     
    2
    .
    If quarantine pests or other quarantine pests of concern to China are found, or soil and plant residues are found, the goods will be returned, destroyed or quarantined and removed.
     
    3.
    If it is found that it does not meet China's national food safety standards, the goods will be returned or destroyed
    .
     
    If the above-mentioned non-conformities are discovered, the Chinese side will immediately notify the Cambodian side and request that the export of pepper
    by relevant production enterprises to China be suspended.
    The Cambodian side should conduct an investigation, find out the cause and implement corresponding improvement measures
    .
    China will decide whether to lift the suspension measures taken by Cambodia on the basis of its assessment of the improvement measures
    taken by Cambodia.
     
    8.
    Compliance review
     
    Before the start of trade, with the assistance of the Cambodian side, the Chinese side will send experts to conduct field visits or remote video inspections of Cambodian pepper-producing areas to ensure that they meet the phytosanitary requirements
    .
     
    9.
    Retrospective review
     
    According to the dynamics and interception of pepper pests in Cambodia, China will conduct further pest risk assessment and consult with Cambodia to adjust the list of quarantine pests of concern to China and corresponding quarantine measures
    .
