New Hampshire Governor Chris Sunuu has signed a law banning the sale of upholstered furniture containing flame retardant (FR) chemicals and restricting the use of firefighting foams containing per fluorine and polyfluoroalkyl substances (PFAS.
The first, SB 193, would ban the sale, manufacture and distribution of upholstered furniture whose coverings or cushioning materials contain more than 1% flame retardants or mixtures of flame retardan.
Exceptions to the ban include second-hand furniture, public-use furniture and mattress.
The law would also empower state attorneys general to require furniture makers to provide a certificate of compliance and include a provision to indemnify retaile.
New Hampshire follows Maine and California in moving in recent years to ban the use of flame retardants in upholstered furnitu.
